Welcome to Electrobuzz! These Terms of Use (“Terms”) form a legally binding agreement between you (“you,” “your,” or “User”) and Electrobuzz (“Electrobuzz,” “we,” “us,” or “our”) and govern your access to and use of our website, services, and digital content (collectively, the “Service”).

By accessing or using the Electrobuzz website (the “Site”) or any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree, do not use the Site or Service.

We may update these Terms at our discretion. Continued use after changes are posted constitutes acceptance of the updated Terms. Please review this page regularly.

1. Eligibility

To use the Service, you must:

Be at least 18 years of age; or
Be at least 13 years old and have a parent or guardian’s consent to use the Service and accept these Terms on your behalf.

Children under 13 are strictly prohibited from creating accounts or using the Service, and we do not knowingly collect data from them. Parents/guardians who permit minors between 13 and 17 to use the platform are fully responsible for all activity under their account.

2. Content Ownership & Usage

All content available via Electrobuzz—including audio recordings, music files, sound samples, loops, artwork, videos, software, trademarks, logos, layouts, and the Site’s overall design (“Content”)—is owned by or licensed to Electrobuzz and protected by international copyright, trademark, and intellectual property laws.

You may use the Content solely for personal, non-commercial purposes, unless you are using it:

Within the U.S. in venues compliant with ASCAP, BMI, and SESAC regulations; or
Outside the U.S. in venues compliant with your local licensing authority.

Except where expressly permitted, you may not copy, reproduce, distribute, modify, transmit, perform, publish, display, license, or exploit any Content without prior written permission from Electrobuzz or the rights holder.

We reserve the right to remove or restrict Content that we, in our sole discretion, find offensive, inappropriate, or in violation of any applicable law or regulation.

3. Account Registration

To access certain features, you may need to register for an Electrobuzz account and provide accurate personal and billing information (“Registration Data”). You agree to:

Keep your information truthful and up-to-date.
Protect your login credentials and account access.
Please notify us immediately of unauthorized use.

You are solely responsible for activity under your account. Electrobuzz is not liable for any loss resulting from unauthorized account use.

We reserve the right to suspend or terminate accounts with false or misleading data, suspected fraud, unauthorized access, or violations of these Terms.

4. License Grant

We grant you a limited, non-transferable, revocable license to stream, preview, and download Content for personal and lawful use only.

This license does not transfer ownership or intellectual property rights to you. Commercial use, resale, redistribution, or public performance without proper licensing or written consent is strictly prohibited.

5. Termination

These Terms remain in effect while you use the Service. We reserve the right to suspend or terminate your account and restrict access at any time, with or without notice, for any violation of these Terms, including:

Account sharing
Download automation or circumvention of technical restrictions
Payment failures or chargebacks
Use of stolen or fraudulent data
Violation of intellectual property rights or local laws

Termination does not relieve you of obligations incurred before termination, including any outstanding payments.

6. Fees & Payments

Electrobuzz may charge subscription or usage fees, and reserves the right to change pricing at any time. All payments are final and non-refundable, including for canceled subscriptions before renewal dates.

You agree to:

Pay all applicable fees and taxes (e.g., VAT, sales tax);
Maintain valid payment information on file.

If your account is terminated for breach of these Terms, you are not entitled to any refund.

7. Copyright & DMCA Policy

Electrobuzz respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA).

If you believe your work has been infringed on our platform, please contact us:
Include the following:

Your physical or electronic signature
A description of the copyrighted work
A description of where it appears on our site
Your contact details
A statement that the use is unauthorized
A declaration, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.

We will act on valid notices and remove infringing content where appropriate.

8. Indemnification

You agree to defend, indemnify, and hold harmless Electrobuzz and its affiliates, directors, officers, partners, and employees from any claims, losses, or damages—including legal fees—arising from your:

Use of the Service
Breach of these Terms
Violation of third-party rights
Posted content that causes legal liability for Electrobuzz

9. User Warranties

By using Electrobuzz, you warrant that:

Your Registration Data is accurate.
You will comply with all applicable laws.
You will not use the Service in a way that violates any right, law, or regulation.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELECTROBUZZ IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF SUCH POSSIBILITY.

Our total liability under any claim is limited to the amount paid by you (if any) for the Service in the past 12 months.

11. Governing Law & Disputes

These Terms are governed by the law of the European Union, without regard to its conflict of laws principles.

You agree to exclusive jurisdiction in Amsterdam, the Netherlands, for all disputes. We may resolve disputes via binding arbitration under the Association Agreement or simply the Association Agreement (AA)

12. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

13. Miscellaneous

This is the complete agreement between you and Electrobuzz.
Section titles are for reference only.
The remainder will continue if any part of these Terms is deemed invalid.
No waiver by Electrobuzz of any term shall be considered a waiver of any other right or provision.
