Welcome to Electrobuzz. These Terms of Service (“Terms”) form a legally binding agreement between you (“you” or “User”) and Electrobuzz (“Electrobuzz”, “we”, “us”, or “our”) and govern your access to and use of www.electrobuzz.net and any related services (collectively the “Service”). By using Electrobuzz, you agree to these Terms. If you do not agree, please do not use the Service.
1. About Electrobuzz
Electrobuzz is an independent underground electronic music editorial platform founded in 2009 and operated from the Netherlands. We publish editorial coverage of music releases submitted directly by record labels, artists, and their authorised representatives. Electrobuzz does not sell, stream, or distribute music files — we publish editorial metadata, tracklists, BPM/key information, and promotional content provided by rights holders for the purpose of music discovery and promotion.
Electrobuzz also operates a Pro subscription tier (pro.electrobuzz.net) offering additional features. Where these Terms refer to “the Service”, they apply to both the free platform and the Pro tier unless stated otherwise.
2. Eligibility
To use the Service you must:
- Be at least 18 years of age, or be at least 13 years old with a parent or guardian’s consent; and
- Have the legal capacity to enter into a binding agreement in your jurisdiction.
We do not knowingly collect data from children under 13. If we become aware that a user is under 13, we will terminate their access and delete any associated data.
3. Acceptable Use
You agree to use Electrobuzz only for lawful purposes and in a manner that does not infringe the rights of others. You must not:
- Use automated tools, bots, scrapers, or crawlers to extract content from Electrobuzz without prior written permission
- Reproduce, redistribute, republish, or resell any editorial content, metadata, tracklists, or database content from Electrobuzz for commercial purposes
- Circumvent, disable, or interfere with any access controls, security measures, or technical restrictions on the Service
- Use the Service to distribute malware, spam, phishing material, or any unauthorised advertising
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Post or transmit content that is unlawful, defamatory, harassing, or that infringes the intellectual property rights of any third party
- Attempt to access any part of the Service you are not authorised to access
- Use the Service in any way that could damage, overburden, or impair our servers or infrastructure
We reserve the right to restrict or terminate access for any User who violates these conditions, at our sole discretion and without prior notice.
4. Intellectual Property
4.1 Electrobuzz Content
The editorial content, database structure, design, trademarks, logos, and software of Electrobuzz are owned by or licensed to Electrobuzz and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Electrobuzz’s own content without prior written permission.
4.2 Third-Party Music Content
All music, audio, artwork, and promotional material published on Electrobuzz is submitted by record labels, artists, and their authorised representatives and remains the intellectual property of the respective rights holders. Electrobuzz does not claim ownership of any submitted music content. Publication on Electrobuzz does not transfer, assign, or waive any rights held by the original rights holder.
4.3 Personal Use
Nothing in these Terms grants you a licence to download, copy, redistribute, or commercially exploit any music, audio files, or promotional materials published on Electrobuzz. All content is presented for editorial, promotional, and discovery purposes only. Where download functionality is provided by the rights holder directly, any use is subject to the rights holder’s own terms.
5. Label & Artist Submission Terms
If you submit a release to Electrobuzz for editorial coverage, the following terms apply in addition to the general Terms above.
5.1 Submission Warranty
By submitting content, you represent and warrant that:
- You are the rights holder or are duly authorised by the rights holder to submit the content for publication and promotion
- The submitted content does not infringe any third-party intellectual property right, including copyrights in any samples or collaborations
- Publication on Electrobuzz does not violate any exclusivity agreement or other contractual obligation to which you are a party
5.2 Licence to Publish
By submitting, you grant Electrobuzz a non-exclusive, royalty-free, worldwide licence to publish, display, and index the submitted promotional content (artwork, metadata, tracklist, biographical information, and any promotional audio previews you provide) for the purpose of editorial coverage on Electrobuzz and its associated channels.
5.3 Retention of Rights
You retain full ownership of all submitted content. This licence does not transfer, assign, or waive any copyright or other rights you hold in the submitted material. You may request removal of your content at any time by contacting [email protected].
5.4 No Guaranteed Coverage
Submission does not guarantee publication. Electrobuzz reserves the right to decline any submission at our editorial discretion without explanation. We do not offer paid or sponsored coverage — all editorial decisions are made independently.
5.5 Indemnity
You agree to indemnify and hold Electrobuzz harmless from any claims, damages, costs, or losses arising from a breach of the warranties in Section 5.1.
6. Electrobuzz Pro
Electrobuzz Pro (pro.electrobuzz.net) is a paid subscription tier offering enhanced features. The following additional terms apply to Pro subscribers.
6.1 Fees & Billing
Pro subscription fees and billing cycles are displayed at the point of purchase. All fees are listed inclusive or exclusive of applicable taxes (including VAT) as required by your jurisdiction. We reserve the right to change pricing at any time with reasonable notice.
6.2 Payments
Payments are processed by our third-party payment provider. By subscribing, you authorise recurring charges to your payment method at the applicable billing cycle. You agree to maintain valid payment information on file.
6.3 Cancellation & Refunds
You may cancel your Pro subscription at any time. Cancellation takes effect at the end of the current billing period. We do not offer partial refunds for unused subscription periods, except where required by applicable consumer protection law in your jurisdiction.
6.4 Termination of Pro Access
We reserve the right to suspend or terminate Pro access for any User who violates these Terms, without refund for any remaining subscription period.
7. Privacy
Your use of Electrobuzz is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. By using Electrobuzz, you consent to the collection and use of your information as described in those policies.
8. Copyright & DMCA
Electrobuzz respects intellectual property rights and maintains a full DMCA compliance process. If you believe content on Electrobuzz infringes your copyright, please refer to our full DMCA Notice & Copyright Policy, which sets out the complete takedown and counter-notification process, our designated agent contact details, and our repeat infringer policy.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.
Electrobuzz does not warrant that:
- The Service will be error-free, uninterrupted, or secure
- Any content published on Electrobuzz is accurate, complete, or current
- The Service will meet your specific requirements
Your use of the Service is entirely at your own risk.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ELECTROBUZZ AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL ELECTROBUZZ’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ELECTROBUZZ IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) €100.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to defend, indemnify, and hold harmless Electrobuzz and its directors, officers, employees, and affiliates from any claims, losses, damages, or expenses (including reasonable attorney fees) arising from:
- Your use of the Service in violation of these Terms
- Content you submit to Electrobuzz that infringes any third-party right
- Your violation of any applicable law or regulation
12. Links to Third-Party Sites
Electrobuzz may contain links to third-party websites including Beatport, Discogs, SoundCloud, and streaming platforms. These links are provided for convenience and reference only. Electrobuzz does not endorse, control, or accept responsibility for the content, privacy practices, or terms of any third-party website. Your use of any linked website is at your own risk and subject to that website’s own terms.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date at the top of this page. Continued use of the Service after any changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of the Netherlands, without regard to its conflict of law provisions. For disputes with EU consumers, the mandatory consumer protection laws of your country of residence apply where they provide greater protection than Dutch law.
Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands, except where applicable law requires another jurisdiction.
